1. Introduction
These terms and conditions ("Terms") govern your use of the claimquid.co.uk website (the "Site") and the services provided by Claimquid ("we", "us", "our"). By using our Site or services, you agree to these Terms in full. If you disagree with these Terms or any part of these Terms, you must not use our Site or services.
Claimquid is a trading name of Claimquid Ltd, registered in the United Kingdom under company number 12345678. Our registered office is at 123 Example Street, London, UK. We are authorised and regulated by the Financial Conduct Authority (FCA), Firm Reference Number 987654.
2. Our Services
We provide services to help individuals assess potential claims for mis-sold car finance and, where appropriate, to pursue such claims on their behalf. Our Claim Checker tool provides an initial indication of eligibility and is not a guarantee of a successful claim or any specific compensation amount.
3. No Win, No Fee Policy (Conditional Fee Agreement)
We operate on a "No Win, No Fee" basis. This means:
- Our success fee is calculated as a percentage of the total compensation awarded. This percentage will be clearly stated in your client care letter and will typically range from 15% to 40% (plus VAT) of the compensation. For example, if you are awarded £1,000 compensation and our fee is 25% + VAT (assuming VAT at 20%), our fee would be £250 + £50 (VAT) = £300. You would receive £700.
- If your claim is unsuccessful, you will not pay our success fee.
- There may be circumstances where you could be liable for costs, for example, if you provide misleading information or breach the terms of our agreement. These will be detailed in your client care letter.
Full details of our No Win, No Fee agreement and any potential liabilities will be provided to you in a separate client care letter before you formally instruct us to act on your behalf.
4. Your Responsibilities
You agree to:
- Provide accurate and complete information to us at all times.
- Cooperate with us fully in relation to your claim.
- Inform us promptly of any changes to your circumstances or contact details.
- Not instruct any other firm or person to act on your behalf in relation to the same claim without our prior written consent.
5. Use of the Site
You must not use our Site in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site; or in any way which is unlawful, illegal, fraudulent or harmful.
Content on the Site is for general information purposes only and does not constitute financial or legal advice.
6. Intellectual Property
We are the owner or the licensee of all intellectual property rights in our Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
7. Limitation of Liability
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Site or any content on it, whether express or implied. We will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, our Site; or use of or reliance on any content displayed on our Site.
This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.
